我以前开的那辆车曾经出过一次车祸,那次的经历曾经写到TIGTAG来。后来换了一辆车,谁知好景不长,又给人撞了。这次是停在路边给人撞的。而且很彻底,报废了。我从不买全保,因为我的车不过五千块买来。不买全保的坏处就是出了车祸只能自己去跑。同事说如果能在3个月之内拿到支票算我LUCKY.所以我给自己订了目标,谨遵同事的教导,几乎天天给保险公司打电话。下面是我对整个过程的追踪纪录,如果大家不幸也有如此遭遇(当然希望没有),相信我的经历会给大家带来参考。虽然我已经尽量减少篇幅,但整个过程实在复杂繁琐,我自己都懒得数发了多少份传真打了多少个电话,可见这种麻烦还是少有为好。
又看了一遍,觉得还是写个总结比较好,因为追踪记录整个是流水账。经验教训:
1.        事故发生后第一时间联系警察和拍照。
2.        如果你的车不是全保,事故不是你的责任,几乎不用考虑联系你的保险公司。除了失望和花电话费之外没什么收获。这是我两次车祸的经验。
3.        多和别人交谈。车祸几乎人人都遇到过,每个人都有各自的经验教训可能对你有用。比如和警察交谈了解事故发生的过程,和其他的当事人交谈了解他们的看法,他们也会给你一些建议。我和邻居交谈得知我有权利租车并让对方保险公司承担费用。和同事交谈得知要多给保险公司打电话催他们加快处理进程,并把每一步动作纸面化,就是发传真给他们,因为这是可以作为法律证据的。
4.        事故处理过程中保持冷静和耐心,因为我的两次经历都告诉我,生气上火没用,着急也没用。在车祸发生之后到完全处理完之前,处理车祸这件事情就像你的工作一样,成了你生活的一部分,只能按部就班来。我每次打电话都表现的礼貌和冷静,这样对双方都有好处。第一次给肇事者,一位50多岁的老太太通电话的时候我表示了同情和关心,因为她并不是有意撞坏我的车,她的车也报废了,本人也受了伤和惊吓,谈话的过程非常平和和温暖。通过这样做,本来很不幸的事情也不会给自己带来太多痛苦。而且整个过程中,跟你打交道的人大多是处在帮助你的位置,没有人有意要跟你作对,这样想,心情会平和很多。
5.        要知道自己的权利与义务,这个可以通过多请教别人的建议得到。
6.        在这个过程中,我打交道的几个local的小公司都非常的好。首先保险公司让我找修车行报价的时候,我打电话给我们当地的拖车公司,本来他们说好要来的,后来打电话过来说,当时他们和修车行都在场,看到过我的车,知道我的车只能报废了,所以拖到修车行不但增加拖车费和修车行的仓储费,而且还会拖延我的时间。他们说我应该直接告诉保险公司我的车已报废,并且可以让保险公司联系他们来证明我的车报废。其次保险公司最初找的那个拍卖行来quote车的salvage value,那拍卖行看过车之后就音讯皆无,浪费了我一大把的时间。后来找了我们当地的一个小废车公司,人家当天就来了,第二天就给报了价,我马上就拿到支票了。我叫他们来拖车的时候也是当天就到,而且还了我的车牌,告诉我可以到RTA去申请refund。他们不说,我还真不知道。他们这种精神非常让我感动,为别人着想,即使自己失去生意的机会也不可惜。我不知道这种公司是不是遍地都是,还是我有幸住在一个好区,人人都如此善良。
051129        Tuesday my car was parked on my street. After work when I came home I noticed something wrong with my car. As the car was at the other end of the street, I went home first. A card from police was at door asking me to contact police as a “victim”. I went to see my car. It seemed to have been crashed by someone and badly damaged. On the windscreen there was a card from a local towing company. I took some photos.
Called police at 6:20pm and spoke to the constable. He gave me a police report reference number to quote for insurance.
Called my insurance company at 6:40pm and was told I only had third party insurance so there was nothing they could do. However they mentioned I could seek help from Legal Aid and I needed to get details from the offending driver and deal with her.
When I went to collect my car, I met the owner of the car parked in front of my car, which was already announced written off in the accident. He was kind enough to give me details of the offending driver.
I managed to take my car to the undercover security parking of our block.
051130        Wednesday I called police at 6:40pm. I officially got details of offending driver. Then I tried to call her (let’s name her P) at home 3 times and mobile 2-3 times. Home number was always busy. No one answered the mobile.
051201         Thursday I called P and gave her my mobile number and she said she would get her husband to call me back. L, her daughter called me back 2pm and gave me insurance details and her mobile number in case I needed to contact them again.
Called A, L’s insurance company. I was asked to tow my car to a repairer and fax them invoice/receipt of towing and quote from a repairer.
Called the local towing company 8:40pm and asked them to come and tow my car. They called me back in 15 minutes and said the repairer was there to see the accident and knew my car was a write-off so they suggested I get A to arrange an assessor to value my car.
051202        Friday faxed a statement to A at 10:30 am. Then called them at 10:50am and confirmed receipt of all 5 pages. I was told they wouldn’t start looking at my claim before Tuesday 051206.
051207        Wednesday 3:10pm called A and arranged an assessor to come Wednesday 051214 to assess my car. He would come anytime between 8:30-4:30. I was told I needed to fax my rego paper to them after assessment.
051214        Wednesday 11:40am the assessor came to assess my car. He would get a wrecker to call me and come to see my car to get the ‘salvage value’. A will give me a cheque less the salvage figure and the wrecker will give me the cheque for the salvage value.
051215        Thursday I faxed the rego paper to A.
051216        Friday I called A 8:50am and was told I needed to speak to the assessor. Upon my request, I was told I could rent a car and send invoice to them and would get reimbursed if cost were ‘reasonable’. I was told cost should be less than $75 per day.
Called the assessor 9:30 am and left a message on his mobile to call me back urgently on my mobile.
The assessor called back at 9:36am:
1.        He called the salvage people yesterday and gave them my details.
2.        They are doing auctions today so won’t be today
3.        They don’t work weekends.
4.        They’ll call me to arrange a time to come and see my car after I come home from work.
5.        After getting the salvage figure the assessor will put a value on my car and send a cheque to me for the difference of the values.
6.        The wrecker will get something in writing so I will be assured I can get the figure they quote.
Contacted a car rental company for a quote for a rental car.
The wrecker called 2pm and would come in 20 minutes to see my car.
The wrecker came at 2:20pm. Noted something and took some photos. Said insurance company would contact me within a couple of days and would organize everything for me. After that the wrecker would get someone come to pick my car.
051217        12pm rented a car at $208 for 7 days returning Saturday. Deposit $200 to be collected when return.
051219        received a form from A to complete as third party.
051221        posted completed form to A in envelope provided.
051223        5:30pm        returned rental car, received $200 deposit back.
051228        2:40pm        after returned from Christmas holiday, called A:
1.        They still haven’t received the assessment report and haven’t heard from the wrecker. If I want I can contact the wrecker
2.        They also haven’t received my completed form.
3.        It is agreed that the delay might be due to the public holidays.
4.        She said I could fax the rental receipt to them mentioning ‘third party hire car cost’ and they ‘will have a look at it’.
060103        Our neighbor is talking about my car staying in the visitor parking for too long.
060104        8:28am fax the rental receipt with coversheet stating situations to A.
Called A 12:45pm and was told no assessment report was received yet. They have received my fax. The rental reimbursement will be included in the settlement. They called the assessor and told me I needed to get the wrecker to pick up my car. He mentioned the wrecker had tried to contact me in several occasions. I know this is not true because my mobile has been on all the time and no one called me.
Called the wrecker 13:15pm. Was told someone would call me back in 5 minutes. Waited the whole afternoon and no one called.
Called A again 4:30pm and spoke to G, who was very kind. He contacted the assessor again. Then he called me back and said the assessor would contact the wrecker and come back to me tomorrow morning.
060105        12.25pm         called A. The assessor called me back and said he would call the wrecker because they hadn’t come back to him yet.
060106         12pm         I called A. No assessment report received yet. I need to call the assessor.
060109         10am        the assessor called me and said they had put a value on my car. They were still trying to contact the wrecker to get salvage value.
060110        11am         the assessor called me and said the wrecker still didn’t do anything. He called their boss and complained about it. And contacted another wrecker S to come and look at my car.
                11:15am        S called me and arranged to come at 7pm to look at my car.
                7:20pm         S came and looked at my car and said he would fax the figure tomorrow morning 7am. A would contact me after that.
060112         9.12am        called A. They had received my fax for the two weeks’ rentals and the assessment report. They were looking at my rental receipts and it would take a few days for them to process the claim. They might send a letter to me informing the amount of the refund, or they might send the cheque together with the letter.
060116         called A. They had sent out the cheque to me on last Friday.
060117         received cheque from A for car total loss value + rental expenses – salvage value.
060118         12:30pm deposited cheque. Called S to come and pick up the car. Towing company came 7pm and towed the car. S came at 8.30pm and returned the rego plate and said I could claim from RTA for rest of the rego fee and green slip. Also issued cheque to me for salvage value.
060119        called A and asked for a letter to be sent to me regarding total loss of my car so I could go to RTA and de-register my car to get some refund of my rego and green slip. They immediately arranged the letter.
060120        received letter from A regarding total loss. Took letter and number plates to RTA and cancelled registration from the date of the accident. Was told refund of around $60 will be sent by cheque to my home address. RTA also issued a letter so I can present to my insurance company for refund of my used premium for CTP.
