Part One – IP Audit
(a)        Identify the intellectual property (IP) assets associated with your chosen Arts organisation.
(b)        Analyse the rights of each item of IP you have identified. Your analysis should ascertain who owns the IP and should outline what rights your chosen Arts Organisation has in relation to the IP. This analysis should include discussion of any restrictions affecting your chosen Arts Organisation’s ability to freely use the IP, and whether any clarification of the IP rights is required.
(c)        Discuss the steps and the adequacy of the steps taken to protect your chosen Arts Organisation’s IP from misappropriation (this analysis should incorporate any improvements you think may be required). If you cannot ascertain what steps have been taken by your chosen Arts Organisation in respect of the protection of its IP, please recommend what you would do in the relevant circumstances.
This part of the assessment will comprise around 1800 words. To keep to the word limit, if necessary, you may confine the scope of your analysis in (b) and (c) to key IP assets.

Part Two – Scenario Assessment
Your Arts Organisation has decided to hold a new event, “AusArt” marketed as being “a celebration of authentic Indigenous arts and culture”. Traditional artwork, song and dance will be incorporated into the event held at Tarntanyangga (Victoria Square), as well as an auction of aboriginal art pieces. You will need to organise and pay the performers at the rates set by them, as well as engage hospitality staff (for entry and food and beverage stalls) and a cleaning business. Attendees will need to purchase a ticket for $150 to attend which entitled them to entertainment throughout the day.

Undertake a legal analysis of the event and potential legal obligations and implications if you fail to comply. Focus your analysis on the following areas:

a) Relevant Consumer Law and Tortious Law that could be at risk of breach, what the breaches would be, what the penalty/implication may be and how you can avoid breaching the relevant laws (include reference to relevant common law). (approx. 1000 words)
b) The laws surrounding auction of art work. (approx. 300 words)
c) The laws surrounding the engagement of contractors and employees, and what rights/obligations those engaged and the business will have. (approx. 400 words)
