Hanson移民留学之四 – TRA最新的六点澄清

自TRA新的JOBREADY PROGRAM公布后,越来越多的TAFE毕业生和在读生陷于进退两难的局面。是留还是走的决定,可能还需要观望几个月的时间,根据自己的实际情况做出抉择。或考虑硬着头皮继续读下去,或考虑转读另外一个较容易寻找工作和申请移民的专业,或考虑在澳做生意,或干脆直接打道回府,回到自己的祖国大干一场。澳大利亚移民局和TRA颁布的雅思四个六和JOBREADY PROGRAM将会严重影响到政府公立TAFE和私立学院的生源,一些往日新生挤得门庭若市的学校目前的情况是新的班级学生聊聊无几,并且仅剩的几个新生看到目前这种状况也是不顾移民局规定需要读满6个月主课的签证要求,在家长的支持下,执意要求转学,在并不一定考虑日后申请移民的前提下,转向各个专业,争取能够最低底线地获得澳大利亚学历或学位,学到以一技之长,为日后无论是返回中国,还是留在澳大利亚做好生存的准备。

TRA今日对新政策又澄清了以下几点要求,仅供参考。

TAFE的毕业生大多数专业的职业评估都属于TRA审理,具体清单参考以下链接:http://www.immi.gov.au/allforms/pdf/1121i.pdf
根据移民局的规定,凡是TRA评估的专业申请人在2010年1月1日没有正式向移民局递交普通类境内技术移民的申请,都需要完成包括长达12个月全职工作的JOBREADY PROGRAM。

TRA澄清一: 2010年1月1日之前旧政策下,用900小时+三级证书获得职业评估的申请人也还是需要继续完成JOBREADY PROGRAM才能继续申请境内的独立技术移民申请。

TRA澄清二:2009年12月31日之前TRA接收到的申请,但还没有完成最终审理的申请,分为以下三种情况:

1. 如果申请人获得TRA申请收到的确认信,并且在2010年1月1日前递交境内永居类签证申请,就不会受到新的政策影响。

2. 如果申请人获得TRA申请收到的确认信,但没有在2010年1月1日前递交境内永居类签证申请,就需要根据新的政策,完成JOBREADY PROGRAM才能递交永居类签证申请。

3. 如果在2009年12月31日前没有收到TRA申请收到的确认信,申请人必须根据新的政策,完成JOBREADY PROGRAM才能递交永居类签证申请。

TRA澄清三: 2010年1月1日前获得成功通过TRA评估,但没有递交境内永居类签证申请的申请人可以用之前通过的职业评估结果,继续完成JOB READY PROGRAM,以继续为境内的独立技术移民做申请前的准备。
申请人需要持有有效的签证在澳大利亚境内,根据自己的澳大利亚学历,提供相应的工作经验证明,选择符合自己的职业提名进行TRA的职业评估申请。
TRA澄清四:第一步的PROVISIONALSKILL ASSESSMENT, TRA需要申请人提供在澳大利亚2年的学生签证证明,并且所从事的工作经验和在学校就读的专业相关。对于提供工作经验的公司规定是,在澳大利亚政府注册的,符合其行业对于使用机器和生产流程标准规定的,并且至少需要经营相关行业12个月。
所提供证明工作经验的文件需要说明具体申请人所完成的工作和职责,可以参考所在行业职业培训的材料。

培训的周期和时间长度是,至少需要每周工作2天,周期是6个月。如果按照每天工作8小时,6个月24周计算的话,预计总长度至少为8x 2 x 24 = 384 小时,比之前的900小时工作经验大大减少了(但TRA并没有给出确切的小时数量,这一点上要十分注意)。值得关注的一点是,TRA规定可以不考虑6个月的周期,在一个例如可能1个月的周期内强化完成6个月每周2天的培训,并且校方提供的正规工作经验,包括在课程中的也能够符合申请的规定。

TRA澄清五:全部JOBREADY PROGRAM的申请费用明确定为共计4550澳元,这对申请人和其家长而言又是一比不小的费用。详细情况如下:
步骤一: TRA预评估申请300澳元
步骤二: JOBREADY EMPLOYMENT 750澳元;额外的培训1200澳元
步骤三: JOBREADY WORKPLACE ASSESSMENT 2000澳元
步骤四: JOBREADY FINAL ASSESSMENT 300澳元
TRA澄清之六:顺利通过第一步PROVISIONALSKILLS ASSESSMENT的申请人可以继续申请有效的临时485签证,获得更长的有效签证时间在澳大利亚境内完成全职的相关工作经验。如果申请没有通过,TRA会说明拒绝原因,并且给申请人提供如何递交重新审核申请的说明。

以上是截止到2010年1月18日TRA对于新政策的六点澄清,没有太多实质性的信息提供,毕竟到目前为止应该还是极少,或者主观说可能还没有新政策下新的申请正式递交给TRA,TRA的工作人员还在为去年年底递交的申请做收尾工作,还有就是根据社会各界的回馈,为新的政策做妥善的修改和填充更具体的信息。
希望TAFE刚刚走出校门的毕业生和新一届的在读生能够根据自己的情况作出适当的调整,也希望澳大利亚移民局和TRA职业评估机构能够给毕业生一个足够时间长度的过渡期,给刚刚踏上澳大利亚求学的新生尽快一个明确的说法和可能给予的例如转专业和签证方面的帮助。再次祝福大家了!

Do I have to apply for a skills assessment under the Job Ready Program?
If you are in Australia and hadnot applied to DIAC before 1 January 2010 for permanent migration through theGeneral Skilled Migration program and are seeking a skills assessment in anoccupation where TRA is the assessing authority, you must apply for a skillsassessment under the Job Ready Program.

What if I hold a successful TRA Migration skills assessment?
You were able to apply forpermanent migration under the General Skilled Migration program before 1January 2010 using your successful TRA migration skills assessment.  Ifyou did not do so you must apply for a skills assessment under the Job ReadyProgram if you wish to apply for permanent migration from within Australia.

What if I am waiting on my TRA Migration Skills Assessment?
People with an application for aTRA Migration Skills Assessment which has not yet been finalised (applicationswere received until 31 December 2009) may be subject to the new arrangements.

If you have a TRA acknowledgementletter about receipt of your application for skills assessment and applied forpermanent migration before 1 January 2010 and your application to TRA issuccessful you will not be subject the new arrangements.

If you have a TRA acknowledgementletter about receipt of your application for skills assessment and did notapply for permanent migration before 1 January 2010 you must apply for a skillsassessment under the Job Ready Program if you wish to apply for permanentmigration from within Australia.

How do I participate in the Job Ready Program if I hold a successful TRAMigration Skills Assessment?
There is a separate process forapplicants with a successful TRA Migration Skills Assessment.
People who gained a successfulTRA Migration Skills Assessment before 1 January 2010 and who did not apply forpermanent migration under the onshore GSM program before 1 January 2010, willbe able to use their successful TRA migration skills assessment if they wish toparticipate in the Job Ready Program.
Online submission for applicantswho already hold a success TRA skills assessment will be availableshortly.  Applicants wanting to apply to participate in the Job ReadyProgram before the online facility is available, can do so by completing the
TRA Job Ready Program Application Form
- only for applicants holding asuccessful TRA migration skills assessment.

The Provisional Skills Assessmentfee under the Job Ready Program will not be applicable for those applicants whohold a successful TRA Migration Skills Assessment.

What evidence do I need to supply?
The evidence required for eachstep in the program is detailed on the Job Ready Program section of the TRAwebsite.

How can I demonstrate that I have met the work experience requirement for theProvisional Skills Assessment?
As part of the Provisional SkillsAssessment, TRA requires evidence from applicants that during the two yearsthat they have been in Australia on a student visa, they have undertaken workexperience relevant to their qualification, in an established commercialoperation in Australia1
usingcurrent industry standard equipment and industry endorsed processes. Theevidence supplied by applicants will need to show that the applicant hasdemonstrated skills in a range of tasks and duties required for theiroccupation, as detailed in the respective Training Package. The period of thiswork experience should be equivalent to two days work a week for a minimum sixmonth period. It may indeed have been completed more intensely in a shorterperiod of time. Work experience completed as part of an Australianqualification can be included where it meets the criteria above.
1An established commercial operation in Australia isdeemed to be a business registered in Australia which has had a positiverevenue history for at least 12 months. Exceptional circumstances will bemanaged on a case by case basis.

How should the evidence be provided?

certified true copies.

Do not send original documents.
Make sure you keep a copy of any documents yousend to TRA for your own records.

Documents not written in Englishmust come with certified English translations.

Do not send applications infolders or plastic sleeves and do not use dividers or spiral binders.

How much does it cost?
The total cost of participatingin the Job Ready Program is AUD $4550.00. Payment is required at differentstages of the Job Ready Program as set out below:

How do I pay the application fees?
You do not have to pay the totalAUD $4,550.00 fee before you start the Job Ready Program. Application fees arepaid at each step of the Job Ready Program.
You must pay by credit card(Mastercard or VISA). You pay by credit card through the Easypay websitemanaged by the Reserve Bank of Australia. The link will be provided when youregister your application for each step of the Job Ready Program online.

You MUST print the PaymentReceipt and attach it to the application form.

You MUST also enter the PaymentReceipt Number into the application form.

I have submitted my Provisional Skills Assessment application, what happensnext?
If you are successful, TRA willsend you a letter which can be included with your 485 visa application to theDepartment of Immigration and Citizenship. This letter will identify anominated occupation. Once you have a visa with work rights you will be able tocomplete the rest of the Job Ready Program starting with Job Ready Employment.
If you are unsuccessful, TRA willsend you a letter giving the reasons for the decision. Advice on how to applyfor a review and how to obtain feedback will be included in the letter.

Can other people seek information from TRA on my behalf?
If you would like someone else tocontact TRA on your behalf, you must supply their details on the applicationform or provide TRA with authority in writing for a person to act on yourbehalf.
