这个属于刑事的起诉。一般来说，刑事起诉分两类，一个是检察官的公诉，一个是私人的起诉。
你可以报知警方，要求警方处理这宗盗窃的刑事起诉。但因为基于对方只偷了你一个笔袋，价值不高，因此警方可能不会采取任何行动。就算采取行动，也可能只会口头上警告对方，要求对方以后不要这样做。实质上也不会有什么作用。
第二个选择是委托律师入禀法庭，作出私人的刑事起诉，在这方面，最主要的考虑因素就是举证的问题。你没有看到他拿你的笔袋，但你必须要找证人证明当时是有看到他拿你的笔袋的。
如果由检察官提出的公诉，这个是免费的，检控科会聘请政府的律师作出刑事起诉。你只需要上法庭给口供便行。但是你想聘请私人律师作出刑事起诉的话，那么你便需要缴付你聘请律师的费用。
