Uni faces court for shelving courses

Hundreds of students have been left in limbo as they wait to discover the fate of two courses at the University of Western Sydney.
The cash-strapped university (UWS) has stuck by the decision to shelve its podiatry and osteopathy degrees for two years, and possibly indefinitely, due to costs.
But it faces a tough battle with the National Tertiary Education Union, which has threatened to take the case to the Federal Court, claiming it is a breach of their enterprise agreement.
But any further action could come too late for the 315 students who had nominated osteopathy - the only degree of its kind in NSW - for this year, 106 of whom listed it as their first preference.
Students were sent a letter in early to mid-December advising them of the possible cancellation and they have until midnight on Thursday to change their preferences.
The NTEU took the university to the Industrial Relations Commission over its decision to postpone the courses, claiming there was no consultation or review before the decision was made. A preliminary statement handed down by the commission on December 21 said UWS had, in postponing the courses, ignored "the requirement to which the university had bound itself".
It gave UWS until last Friday to provide details on the implications for staff in the two programs. A UWS spokesman said the university had submitted information to the commission indicating that no staff would be adversely affected and said UWS would stand by its decision.
"The union claims that our staff will be displaced by the decision not to take in new students into the osteopathy and podiatry programs, but this is not true," the spokesman said.
"Our teaching staff will not be affected. They will continue to teach the senior years of both courses, and will now be able to spend time to further improve the courses."
NTEU senior industrial officer Chris Holley said the union would decide on Tuesday if it would seek further orders from the commission or take the matter to the Federal Court. "They made an absolute knee-jerk decision," he said.
