[color=]A Student has completed their degree in November and their student visa is due to expire in March of the following year. The student wants to apply for one of the onshore skilled-overseas student visas. They prepare their application and lodge it, by posting it to Adelaide Skilled Processing Centre, just before their student visa expires. They expect to move on to a bridging visa A when their student visa expires, on the basis of having applied for a substantive visa (the skilled visa). However, in April the applicant received a letter from Immigration informing them that, because they did not include an Australian Federal Police check certificate done in the last 12 months, their application for the skilled visa is invalid. At this point, the student no longer holds a student visa (it having expired in March) and is not entitled to a bridging visa as they have not made a valid visa application. The former student is then an unlawful non-citizen. Unfortunately, now the former student cannot correct this mistake and make a fresh application one of the other rules for making a valid visa application for the skilled-overseas student visas is that the applicant must not have been an unlawful non-citizen at any time in the six months immediately before applying. To continue to apply for skilled migration, the former student will need to leave Australia and apply for one of the offshore skilled visas. However, to get the benefit of the exemption from students will need to lodge their offshore skilled visa application within six months of completing their course.
