关于回国离婚问题

也有往返大陆回乡证 。他们在中国大陆注册结婚的， 现在闹不和， 想回国办离婚。 这样的话， 女方需要用澳洲
护照在申请中国签证吗？ 还是
直接用
回乡证就可以呢？ 离婚的机关会要求出示外籍华人的
护照签证吗？我朋友最近心情很差， 所以上来替她问问。

看了你的帖子，好像女方是香港居民，持有香港护照和往返大陆的回乡证。最主要的关键是三年前和男方结婚的时候，她是拿香港永久居民身份证还是回乡证在中国的民政局办理结婚手续的？
现在中国的电脑非常发达，因此她回中国办理离婚的时候，必须依照当时结婚时候的身份才可以办理。因为现在中国是不承认双重国籍的，因此如果她拿了澳大利亚护照，那么问题就会比较复杂化，因为中国的民政局是不会代理海外公民办理离婚手续的。
我提议你向你的朋友问清楚，当时她结婚的时候是否用的是香港永久居民身份证还是往返大陆的回乡证。如果这样的话，她必须相应出示香港永久居民身份证或往返大陆的回乡证，中国的民政局才可接受她的离婚申请。
除非你的朋友当时申请注册结婚的时候，是用澳大利亚护照，否则，当你朋友在民政局办理离婚时，一提供澳大利亚护照，民政局便会拒绝申请，并要求她在国外原居住地申请离婚。

谢谢回复，她当时是用澳洲护照在北京注册结婚。依上述所言， 如果她用澳洲护照（申请中国的签证）回北京离婚，将不被接受，对吗？

你好！
在这种情况下，你的朋友的情况会比较复杂。
依据现行的中国民政局的内部指引，任何人士持有外籍护照，只需要在原居住地拿一份《无结婚记录证明书》即单身证明书，便可以在中国的民政局登记结婚。
如果你朋友当时是持澳洲护照登记结婚的，那么情况便比较复杂。因为一般来说民政局是不帮持有外籍护照的人处理离婚程序的。并会告诉持该外籍护照的人士到原居住地申请离婚手续。
以你朋友的情况，可以要求你朋友的先生申请离婚，然后她以答辩人的身份到民政局配合离婚的程序。看这样是否可以顺利完成有关离婚的申请。
因为她老公是中国的公民，因此在一般的情况下，民政局都不会拒绝她老公的申请的。
